2. If it does just come on with headlights, is there a legal issue with the lights being on while driving?

2. Or do we still use Aux switches? - Yes, but it can be achieved, just need to add the wiring harness that connects to AUX

If I'm not mistaken, I believe for these to be legally allowed for using on the road, they have to be DOT or SAE approved. If using them for offroading then it doesn't need to be approved and is fine. But someone with more knowledge may be able to give a better answer.
