EHH, well either way her insurance should be taking care of it. Does it suck, yes, but that is what insurance is for.
Sad thing is you drive their vehicle and wreck it, it's on you. If the dealer wrecks yours, it's also on you.

I deserve a priority order Jorge is that you?

Believe this may be same dealer that has sales people awarding themselves priority orders for all their hard work.
He did and he feels he's doing his customers a favor by letting them look at it.

The dealer didn't total the car. I watched the video and it clearly states that a car turned left in front of the mechanic driving the customer car.

What needs to be highlighted here is the fact that insurance companies in TX can somehow magically assign percentages of liability to each driver involved. This is a perfect example of why everyone should have a car cam installed.
Again, we have one side of a story. Was the dealers driver distracted (texting)? Was he road testing the car or going to pick up lunch like the Toyota salesman seem to do in their commercials with cars on the lot?

Does my car insurance cover me while driving someone else's vehicle? The general rule of thumb is that car insurance follows the car, not the driver.
Here in AZ, I need to provide my insurance card when test driving or borrowing one of their cars.

From the article

"Tomball Ford did provide Walker with a rental car for three weeks. But when they asked her to turn it in, they were still battling Allstate, leaving Walker with no vehicle, no down payment, no settlement money and a car loan she still has to pay."

So they provided a car then took it away too soon. Honestly the dealership needs to understand this isnt really about who's right or who wrong its about good PR and repeat customers. The committing the wrost thing they can do by not make this easy for their customer.

I shouldnt know Tomball Ford exists but now i do and if i lived in the area i wouldnt take my car to be serviced there. Dealers are living in this world of archaic thinking that customers dont talk to each other or realize theres another dealership down the road that will treat them better. This is a PR nightmare that they could of made go away for probably 10k
People reading that article should indeed think twice before going there. Tomball already demonstrated what to expect if something happens to their car.

I had a buddy that took a car into a dealership for service and it was stolen off the lot overnight. He was as stuck in a bunch of back and forth about who was liable.
In the end, his insurance paid him out and took it from there.
He was pretty pissed but not much he could do.

" The police report supports that and assigns all blame to the other driver. "

He wasn't found at fault by authorities. So, no, he wasn't. But that doesn't stop the insurance companies from trying to save money.

This is probably standard "opens" in the insurance company's negotiations. And if nobody pushes back and just accepts it, then the insurance company just got a cost avoidance to put on their books. The driver needs to get her insurance company involved as well as the Dealer's insurance company so they can both tell All State to get f%$ed and pony up 100%. That will take time but hopefully she has car rental on her policy so she at least has a ride while they sort it out.

Their salesman Jorge Lopez ordered himself a Bronco and feels justified in getting it before any of his customers get theirs. That's the kind of dealership Slimeball Ford is.
Yes, Tomball Ford is the dealership northwest of Houston with 25 FEs, and Jorge Lopez, the Bronco Specialist, awarded himself a Priority order because he felt he was working so hard he deserved it…

I feel as though the Police report supports the fact the other driver pulled in front of the mechanic, but doesn't show any proof the mechanic wasn't distracted and possibly could have seen him in time to avoid the collision. It appears nobody actually witnessed what happened, so we'll likely never know.

I'm not disputing the report states that. They can only judge by what they saw 10-15 minutes after the accident. By then, if the mechanic was on his phone, it would be back in pocket.

How the fuck does a vehicle get that fucked up when it's only in for an initial oil change?

Why was it being driven on the street? It's not one of those urban dealerships with multiple building in different locations, is it? Cause I've had to deal with that bullshit.

WHAT THE FUCK.

Because they take your car to run errands and get lunch and call it a "test drive" to check the repair.

The whole wreck thing is sketchy. If Insurance is with “The Car” and not the driver, how can Allstate randomly assign 30% to an individual that has zero liability??
I don’t know the salesman Jorge, but if he’s actually letting people off the street test drive his Bronco then more power to him getting the Priority. I ain’t letting any of you MF’rs drive MY Bronco!! ;)

Plot twist (without reading the article)... the mechanic is actually the customers boyfriend, who tells her it has a serious engine problem... she whines about it not knowing how she’s gonna get another car on her limited income... mechanic, being an awesome boyfriend, decides he’ll take it to get lunch and inadvertently have a crash, letting the dealerships insurance take the blame and getting her a new car. Little did he realize, there is a much bigger crook out there than car dealerships... called insurance companies. So now his good deed towards his girlfriend has turned into a huge dilemma... and will only get worse when she dumps him for the buddy he called to help him with the staged crash.

Note: this is purely for comedic purposes, but is probably just as close as most of the speculation on here to being a true happenstance... just sayin
