It does open to 120 degrees but in @Sharks reply to you he mentions that his spare tire hits his rack even with the pivot all the way open.

I've been looking to pick up a pivot and I saw that you can get either a passenger or driver side swing. I've only seen pictures of the passenger side but I worry that the tailgate/spare will swing into my bike on the rack since the pivot doesn't open as far as the tailgate will. Do you see this...
