So, not sure if this is cosmetic only or going to allow water in.

Passenger side rear passenger panel meeting up with rear panel looks like black foam under the top

It's not supposed to look like that. You may want to check that all the small levers are locked properly. It could be a bad picture angle. Can you please provide more pictures (perpendicular level, perpendicular from above, one from a bit farther)?

Let me check the levers. Also it's been raining for a couple hours. Gonna check if there is any water inside -- when I leave work

Last week I noticed mine was like this also, not sure if it’s been this way the whole time though.

Well, truthfully not sure myself. But, I am very anal about things not being symmetrical, so I think mine is new and maybe related to the Cold weather.
On a good note, I checked this evening after work, I could not detect any water leaking in.
Nothing was wet/damp on sound deadening material, or no visual water inside or dripping near that area.

I will check in the morning. Will definitely inform dealer when I take it for first oil change next month.

I got the same thing going on, no leaking as well. The middle panel appears to be be bowing out at the edges. I think there's too much latch pressure and over time its reshaping itself.
Was like this new |---| now its like this /---\
