Smart play, I’m on your side 100%. Not saying you are but if you were to flip it it’s your perogative you chose them. Have you heard from ford? I would kindly ask for a raptor allocation at another dealership. Also I posted a similar story months back about a woman in Texas. The dealer ended up getting her another bronco after ford stepped in.
Ford was unable to do anything sadly. I did request a raptor allocation. Waiting to hear.

I’m sorry to hear that you had a horrific experience! It seems like you had a signed deal and that could be a binding contract. I’m not sure cuz I’m not an attorney but maybe you should contact one. I had a great experience with my dealership here in East Texas. San Augustine Motor Company was incredible to work with. Thanks John aka Uncle Buck!

I offered to the dealer to sign an agreement not to resell for 24 months at MSRP. I was not going to do that at 25k over sticker since I felt the order was mine for sticker. They offered me a deal no sane person would ever take simple as that. I saved money for 6 months to get this truck at sticker. Here is the agreement sent to me.

So you offered to sign an agreement, but did not actually sign it.

That’s how I interpreted the situation, based on what I read. Thanks for clarifying.

Did the dealer ever raise a concern about you possibly exporting the vehicle?

He offered to sign that agreement at MSRP. They countered and said 25k over sticker plus he sign the agreement.

You're confusing when you own the vehicle with what constitutes a contract.

If I'm buying a house and put it under contract I don't own it until closing, but when the seller and I sign a contract and I put down earnest money the seller can't just give my money back and say "oops, had a better offer, sorry, but you didn't own it yet".

Car dealers are no different. If the dealer's agent and I sign a document, and exchange consideration (money), we're bound by those terms unless we both agree to changing the terms. As a buyer, don't sign anything unless you're willing to be bound by the terms.

Are there issues with this particular "contract"? Yes, but that doesn't mean it may not still be determined to be a contract under the law. For the money involved, plus the time, I would certainly engage an attorney.
By the "contract" page shown in this thread, couldn't the dealer simply place a MY22 Badlands order to complete his end ?

As an attorney myself, and speaking to colleagues. We all feel its a strong argument based on the texts, etc. Documents.
If there's anything on the dealer paperwork with your reservation or order number I think you have a strong argument to tie it to the exact VIN through the Ford communications, negating the "no VIN" argument, and possibly the "Badlands" issue.

Hey Razor, I have no clue how to export a car. Never have done it. There were multiple agreements signed. Ill post. I hate that people are claiming I'm a flipper. I own a 72 Stroppe, and a 92 Nite Edition. I added extra options for personal use. I drive a 2002 Lincoln Blackwood which literally leaks when it rains. It was time for a new ride.

No because the agreement (Totality of circumstances) shows an agreement for a 21 FE. We all knew what truck it was, no one is thinking it was a badlands.

Thanks, Tom.

Just for clarity, I am not claiming you are a flipper. I am simply trying to determine what is the underlying basis of the dealers’ argument (e.g., likely a reseller capturing ADM that the dealer believes they “deserve” instead), and what they might potentially be hanging their hat on as an official excuse (e.g., possible “export” concerns).

For sure. I've never exported a car in my life. No clue how to. Never imported a car. The last thing I sold was a 1970 GTO if my memory serves. It was a rustbucket in February. I do help people sell cars on the side via my website, but I have not SOLD one car of mine on there ever. If I ever did, it would be simply because I have 2 broncos, a delorean, a 67 gt500, and my daily truck and once something comes home from restoration, I need room. I don't flip cars. I drive them and enjoy them. My collection would not be so big and have 2 broncos which ive had over a year if i did.

I have almost purchased a vehicle from this group. They do trade in some unique and special vehicles. I would very wary of ever ordering a special vehicle from them.
