A guy made a flat plate with some holes in it, put the dimensions on his computer and offered to give it for free to anyone who wanted to do the same and you start threatening a patent infringement lawsuit.

Sorry man, that's what patents protect. People trying to take someone elses design and make it available. If you don't like it you can petition the courts, but you won't win that. That's why companies spend so much money protecting their inventions.

We were first to market with this and made sure to protect our invention.

Thus my warning obviously. You even stated in your original post "Is it bad form to do so?" and I advised you of our patent on the product so that you didn't get yourself in trouble.

I asked of it was bad form, not if it was infringement, which it isn't. Even if it was a direct copy, which it isn't even derivative much less a copy, there's no money exchanging. The question was form. I know you are active here, that was the point was to start dialog with you. I didn't want to be rude, I know I'm legally good to go. If you had said "hey man I'd rather you wouldn't we just came out with this" I would have deleted the post. This got entertaining real quick. While I like Adam's knowledge of lighting and I think he has a lot to offer the community in that respect, I've always thought the "patent pending" on a bracket was a bit of a stretch particularly when there's already so many available in the off-road community that only vary in application. I think he could have handled this privately and not rolled out the threats. Bridges burning.

I'll wait on ARB to come out with their own mount at this point.

You aren't trying to sell anything. The number of people who take time to fabricate their own brackets is a minuscule portion of the market and wouldn't have cut into his sales yet he is still bullying you. Because of his threats, I am most definitely going to create my own ARB mounting brackets.

I am just hoping to be able and enjoy a a beer or two over this dumpster fire this evening. But I believe the forum overlords are going to shut it down at the request of a vendor.

As for the patent pending it would be my guess that is part of a long game and being able to sell something to a deeper pocketed company like ARB.

You're free to post your design for others to fabricate, and if 4x4s patent isn't denied in 3-5 years, and is by some miracle approved, then they can sue you for the royalties you received.

I think I'll creative commons license it so no intent to profit can even be fathomed. I was excited to share it with everyone while I was beating it flat with a hammer. Now I wish I had not bothered. Cat is out of the bag now.
