Was he road testing the car or going to pick up lunch like the Toyota salesman seem to do in their commercials with cars on the lot?The dealer didn't total the car. I watched the video and it clearly states that a car turned left in front of the mechanic driving the customer car.
What needs to be highlighted here is the fact that insurance companies in TX can somehow magically assign percentages of liability to each driver involved. This is a perfect example of why everyone should have a car cam installed.

I shouldnt know Tomball Ford exists but now i do and if i lived in the area i wouldnt take my car to be serviced there. Dealers are living in this world of archaic thinking that customers dont talk to each other or realize theres another dealership down the road that will treat them better. He wasn't found at fault by authorities. So, no, he wasn't. But that doesn't stop the insurance companies from trying to save money.
This is probably standard "opens" in the insurance company's negotiations. And if nobody pushes back and just accepts it, then the insurance company just got a cost avoidance to put on their books. The driver needs to get her insurance company involved as well as the Dealer's insurance company so they can both tell All State to get f%$ed and pony up 100%. That will take time but hopefully she has car rental on her policy so she at least has a ride while they sort it out.
