FWIW, I've been conceptualizing an ARB mounting platform for my Bronco, but since I don't even have a VIN yet, the litigation outlined in this thread will have already set the goalposts for what's acceptable.

Currently leaning towards using metric hardware, because it's a unit of measurement I invented while drunk last weekend, and not anything anyone else has used.

I get both sides here, but ultimately I side with 4X4. I was in the Mfg. business for over a decade making boutique products. Intellectual property is no joke. It's the backbone of capitalism which = Freedom. He may have been harsh, but in Mfg. a hot product, litigation is an everyday thing. He was right to give you a heads up! My lawyer in the cigar biz had a couple guys scour the internet every day for anything related to my products!

I asked of it was bad form, not if it was infringement, which it isn't. Even if it was a direct copy, which it isn't even derivative much less a copy, there's no money exchanging. The question was form. I know you are active here, that was the point was to start dialog with you. I didn't want to be rude, I know I'm legally good to go. If you had said "hey man I'd rather you wouldn't we just came out with this" I would have deleted the post. But now that I know you are a complete and total egotistical jackass I'll be leaving it up for the world. Let your lawyer know about as well. Loser.

My whole intent was to contribute to our community here. You apparently just see it as a piggy bank. Next time I break out my drill bits and torch I'll be sure to run my drawings by you first.
LMAO Some of you guys just don’t seem to understand. If you are giving away a product that a company has a patent on. The company is losing sales and is being damaged . They most certainly can sue you for lost sales. Just because you think you are safe because it‘s free doesn’t make you safe. Please come back and tell us the lawyer fee to defend your position. I imagine it’s going to be much more than just buying product. 😂🤣

Share the patent number please.

If it’s a design patent, good luck. Anyone can arbitrarily change the shape and get around it.

If it’s a utility patent, I doubt it would even issue. There isn’t anything novel enough about a metal bracket of any sort to warrant a utility patent. Even if there was, it wouldn’t be worth the cost to defend it. There’s no business case.

The problem is that the "product" which is claimed to be patented (of unknown patent, type or intent), is of a common type which has been in existence and common usage for decades.

People have been fabricating brackets to hold things inside the engine bay of their cars since the 1930's.

So the question here is instead of being:

  • Hey, I came up with a way to make fried chicken, who wants to see how it turned out

  • I'm informing you that I might sue you if you ever try to make fried chicken in any capacity because i've used 11 proprietary herbs and spices to make fried chicken
Fried chicken can be made many different ways with many different ingredients. KFC is a prime example here, their 11 Herbs and Spice Girls are proprietary, licensed trade secrets, and they defend that. But it does NOT exclude others from making fried chicken. In fact, it's not a violation of KFC's trade secrets for former KFC chefs to start their own fried chicken restaurants just so long as they don't use those same 11 Herbs and Spice Girls in the same ratio that they learned from KFC



As always, the devil is in the details. But based on the technical information presented in this thread to clearly identify the intellectual property 4x4 owns at this moment, it's not clear how this specific bracket has proprietary and unique function.

If 4x4 has made some incredibly special bracket mounting solution or an actual unique product for which has not existed or in a conceptually new way that brings proprietary items to market than he absolutely owns that!!!! Nobody is doubting that.

But if I use a sheet metal bender to fabricate a bracket to hold my screwdriver in the engine bay with common hardware, i'm hardly in a position to be "lawyering up" to go sue every off-road product manufacturer for stealing my "idea" of fabricating a bracket.....

If someone wants to build their own. Do it and keep your mouth shut. But, come on a forum and give out the information. That’s not the smartest idea. The patent may be as useless as a broken screwdriver. That’s not the point. The OP gets to drop serious money on a lawyer If they decide to go after him. Much much more than that $250 just to buy the bracket.

I’m not going to fault a company for getting pissy with someone they gave a gentle warning to and then he doubles down on it. They been extremely fair to me.
