Help! Dealer refusing to transfer title

@flip is the 90 day requirement for X-plan new?? I don’t remember that being there before. (Selfishly I’ve never really paid attention the X-Plan details since I usually use A/Z-plan. So I may be wrong.)

If so that may be what’s missing. Needs to prove 90 days of employment. Or maybe Ford is stepping up audits because of that new requirement.

The Better Business Bureau is meaningless - completely 100% meaningless. They were once nothing more than a pre internet Yelp Review for companies to either join or not join to get credibility in the market place. Yes, too many complaints against a company can get them kicked out of the BBB if and only if they were members to begin with, but in the days of the internet and online reviews, it really means nothing. I know I've never vetted a company through the BBB before buying their goods and services - have you?

Withholding your car payment is a really bad idea, that's your stake in the game. Plus that money has nothing to do with the dealer, they already got paid, you are punishing the creditors for the crimes of the dealer - makes absolutely no sense, legally or logically, not to mention you will ruin your credit score.

The dealer not handing over the paperwork can become a legal issue, in which the dealer will lose, you shouldn't need a lawyer, you have a contract. Goods were given in exchange for money, it's really cut and dry.
With that said, I know this is a state to state thing, but in NJ, when you get a car loan - the creditor holds the title, so here it wouldn't even be our problem. I'm guessing where you live, you get to hold the title even if the vehicle isn't paid off.

And most importantly - DO NOT TAKE LEGAL ADVICE FROM SOMEONE ON A CAR FORUM AND ACT ON IT.

Do your homework, you have no idea who's typing on the other side, could be a 15 year old taking bong hits, watching porn and messing with you because they aren't getting enough attention in real life.

Why does this feel like we aren't getting the full story? OP has stated that they have provided documentation, but that the Dealer has asked for proof of employment. What EXACTLY is the dealer disputing? The OP claims that they just "know" that the Dealer is going to ask for more money... but the Dealer has not asked for more money. Something feels like we are not getting a key bit of information here.

This doc is from Dec. 2023 so I assume the most current. The 90 day thing may have been added when everyone was rushing to join the Mustang club in hopes of getting X-Plan when Bronco came out. This is just a guess on my part.

You need to read more closely then.

They're asking for me to provide another copy of my proof of employment as a means of verifying X Plan eligibility.

I provided this during the sale process before getting the car.
I provided this again about 4 hours after the request last night.

Bottom line:
- I have the car in my posession.
- They have my trade in car.
- My loan has been executed and the funds distributed.
- I have a sale contract.
- Despite all of this the dealer is refusing to either title it or provide the plates (I suspect its title it, because I did a search on the VIN last night and there's no ownership/title info on record).

As for my comment about more money - what I suspect is that they're holding off titling the vehicle because of a dispute between the dealership and X Plan, and that if X Plan refuse to pay the dealership then the dealership will demand more money from me.

Who is the eligible partner you're getting X-Plan through?

I've just spoken to the sales director and he seems to have worked it out. I am collecting my plates today.

It seems that one or two of the employees went rogue and acted against policy, making threats to me that they were not empowered to make.

EDIT: he just called back, there was a miscommunication, my plates are *not* there, but they're saying they'll give them to me when they arrive.

This is driving me nuts...

That is not the complete list of eligible employers. That is a list of CLUBS which are eligible.

Your choice not to say who the employer is, was just going to look it up on my end to make sure it was on the current list in the program site. No worries, glad they got it worked out.

I wonder how often with cases like this we don't hear the whole story? One thing is for sure, the dealer knows the laws, they do this every day. There is another side to this.

Its really sad that people would simp for a dealer thats clearly in the wrong, but thats your choice.

Its not new, that has been around for a long time, it has also been documented on the MCA side as a requirement to be a member of MCA for 90 day min to get access to the Xplan stuff.
